BOOKING CONDITIONS

The Regulations define the rules for booking and renting short-term apartments in Ustronie Morskie through the website at the URL www.sailor-klif.pl

CHAPTER 1: DEFINITIONS

  1. Service Provider – GMS Global Sp. z o.o. (address: ul. Zagórska 83, 42-680 Tarnowskie Góry),  registered in the register of entrepreneurs KRS  0000784955  (District Court in Gliwice, 10th Commercial Division ofthe National CourtRegister), TAXID: 645-256-01-66, REGON 382526170;
  2. Website – a website made available by the Service Provider at: www.sailor-klif.pl;
  3. Apartment page – a subpage on the Website, where detailed information about the apartment is presented;
  4. Working days – days of the week from Monday to Friday, excluding public holidays;
  5. Client – a natural person with legal capacity, a legal person or an organizational unit not being a legal person, the special provisions of which confer legal capacity, making a Reservation through the Website;
  6. User – any person using the Website;
  7. Apartment – furnished and equipped residential premises described on the Website, which is the subject of the Reservation and Rental Agreement, which is made available to the Client for leisure or recreational purposes;
  8. Rental Agreement – a contract for the short-term rental of an Apartment within the meaning of the Civil Code, for recreational or recreational purposes concluded with the Client by the Service Provider in the name and on behalf of authorized owners of the Apartment using the Website; the duration of the Lease Agreement is calculated in Dobach;
  9. Reservation – providing the Client with the opportunity to conclude a Rental Agreement and to use the Apartment selected through the Website, under the conditions indicated in the Booking Confirmation and these Terms and Conditions;
  10. Day – the unit of the duration of the Lease Agreement, the Day begins at 16:00 on the day of the Client's arrival and ends at 11:00 on the day of departure of the Client, unless agreed by the parties (or with the Resident of the apartment) other hours of use of the Apartment;
  11. Resident – a person acting on behalf of the authorized owner of the Apartment, indicated to the Client by the Service Provider as a contact person for the reservation;
  12. Price – the gross price representing the product of the Apartment Price and the amount of Dób for the use of the Apartment, including the cost of cleaning the Apartment after the Client leaves it. The price does not include the climate fee and any other additional charges accepted by the Client (e.g. the cost of cleaning the Apartment after use by the User), these fees will be added in addition to the Price;
  13. Prepayment – a fee of not less than 50% of the Price for the Service, which constitutes a deposit within the meaning of Article 394 of the Civil Code, subject to the price. The parties may agree on a different amount of Prepayment or waive its collection;
  14. Consumer – a natural person carrying out a legal act with the trader not directly related to his economic or professional activity, as defined in Article 22(1) of the Civil Code;
  15. Civil Code – Law of 24 April 1964 The Civil Code (i.e. Journal of Laws of 2014, item 121, as amended. as amended);
  16. Act on the provision of electronic services – Act of 18 July 2002 on the provision of electronic services (i.e. unit. Journal of Laws of 2013, item 1422);
  17. Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended);
  18. Terms and Conditions – these terms and conditions governing the reservation and short-term rental of Apartments offered through the Website.

CHAPTER 2: GENERAL PROVISIONS

  1. The reservation of apartments offered on the Website and the implementation of rental agreements takes place on the basis of these Terms and Conditions and generally applicable laws. These Regulations are the regulations referred to in Article 8. Act on the provision of electronic services.
  2. Please note that the number of eligible Apartments offered is limited. The execution of reservations for such Apartments takes place in the order in which they were submitted by clients.
  3. The information provided on the Website (in particular regarding prices) does not constitute a commercial offer within the meaning of Article 66 of the Civil Code, it is only a call for tenders as set out in Article 71 of the Civil Code.
  4. All prices quoted on the Website are expressed in Polish zlotys and are gross prices (including VAT). The price includes utilities (electricity, water, gas, heating – during the heating season, waste water disposal and garbage collection), TELEVISION and internet access.  Due to the consumption of media in the Apartment, the Customer does not incur any additional costs. The price may also include other benefits described in detail on the Apartment Page. For any services not covered by the Price, the Customer must pay on-site payment during the stay.
  5. The rental of Apartments offered on the Website is of a short-term nature and does not serve to meet the permanent housing needs of clients, and therefore the provisions of the Act of 21 June 2001 on the protection of tenants' rights, the housing stock of the municipality and the amendment of the Civil Code (i.e. one of the following do not apply to it). Journal of Laws 2014, item 150, as amended. as amended).
  6. It is forbidden for Users to use the Website to send unsolicited commercial information, spam within the meaning of the Act on the provision of electronic services, as well as the use of the Website in a manner contrary to the law, good manners, violating the personal interests of third parties or the legitimate interests of the Service Provider.
  7. Your use of the Website requires the following technical requirements:
    1. IE browser, Firefox, Chrome, Opera in the latest version or in the version preceding the latest version;
    1. Operating systems Windows, Mac OS, Linux, Android, iOS;
    1. JavaScript enabled, Adobe  FlashPlayer version  9+, HTML5;
    1. Internet access;
    1. E-mail box - in the case of the Newsletter or the User's willingness to receive information / responses via e-mail or express the User's willingness to receive marketing and commercial information from the Company;
    1. Enabled cookies and html5  localStorage.
  8. Direct contact of the User with the Service Provider is possible by e-mail or phone. All contact details of the Service Provider are given on the Website in the CONTACT tab.

CHAPTER 3: ELECTRONICALLY SUPPLIED SERVICES

  1. The services provided electronically under these Terms and Conditions consist in enabling Users to make Reservations through the Website, as well as making the newsletter service available. These services are free of charge for Users.
  2. The use of the newsletter service is possible by any User who, when making a Reservation, unchecks and thus activates the relevant field in the Booking form or enters the e-mail address in the appropriate field provided on the Website. Upon subscription to the newsletter, an agreement for the provision of electronic services is concluded between the User and the Service Provider under the conditions set out in the Regulations.
  3. Users may not upload content that could in any way violate the personal interests of third parties or the Service Provider, or violate any other rights of third parties, including copyright and related rights, industrial property rights, trade secret. It is also forbidden for Users to post and send any content that is offensive, violates morals, legal regulations or social norms, or content containing any personal data of third parties without their consent, as well as content of an advertising nature.
  4. The contract for the provision of electronic services by the Service Provider in the scope of the newsletter is concluded for an indefinite period. You may terminate this agreement free of charge at any time with a 14-day notice period. Termination of the contract for the provision of electronic services is also possible with the mutual consent of the parties.  Termination or termination with the consent of the parties to the contract for the provision of electronic services shall not affect the performance of reservations already made, unless the parties agree otherwise.
  5. The service provider may terminate the contract for the provision of services by electronic means with a 14-day notice period if:
    1. the purpose or use of the services is contrary to the principles and purpose of thewebsite;
    1. your activity is contrary to applicable moral standards, incites violence or committing a crime, and if it violates the rights of thirdparties;
    1. The Service Provider has received an official notification of the unlawful nature of the user's data provided or relatedactivities;
    1. The Customer or user is permitted to send unsolicited commercialinformation;
    1. Customer or User in a gross or persistent manner, violates the provisions of theRegulations;
    1. the address data provided by the User raise objectively reasonable doubts as to their correctness or truthfulness, and these doubts have not been removed by telephone contact or by e-mail.
  6. The Service Provider makes every effort to ensure the proper and uninterrupted operation of the Website. In the event that the services or other services offered by the Service Provider indicated in these Regulations, e.g. are incompatible with it, do not work properly, the User has the right to lodge a complaint. Users are asked to submit a complaint in electronic form to the e-mail address: apartamenty@sailor-klif.pl or in writing to the address of the Service Provider. Users are asked (in order to improve the complaint handling process) to indicate their personal data in the complaint and to describe the objections raised.
  7. Complaints regarding electronically supplied services are considered within 30 days of the submission of the relevant complaint, in accordance with the applicable regulations. The User will be informed about how it will be considered by the Service Provider.

CHAPTER 4: RESERVATION AND CONCLUSION OF THE LEASE AGREEMENT, CANCELLATION OF THE RESERVATION:

  1. Booking on the Website is possible 24 hours a day, 7 days a week.
  2. In order to make a Reservation on the Website, the User is asked to do the following:
    1. make a selection of the Apartment, indicate the time frame of the apartment reservation from among the dates available on the Apartment Page (on the displayed schedule on the Apartment Page dates marked in white indicate the free to book apartment, and dates marked in gray- dates already booked), then make a selection of the number of guests, then choose themethod of payment:
      1. free cancellation: The reservation can be cancelled free of charge up to 7 days prior to arrival. In this case, the prepayment will be refunded within 14 days of the cancellation. In case of cancellation after this date or no-show on the day of arrival, 50% of the reservation will be charged. A prepayment of 50% of the booking via the online payment system is required to guarantee the reservation;
      1. non-refundable booking: Payment for the entire stay in advance via the online payment system is required to make the reservation. In case of cancellation or no-show on the day of arrival, the prepayment will be forfeited;

CHAPTER 5: PAYMENT METHODS

  1. Prepayment and Pricing payments by the Customer are possible as follows:
    1. Electronic payments made in the manner: The Client making prepayments or Prices through the Website selects as a payment method the tPay payment system and is redirected to the transaction service. After logging in there, the Customer receives an accepted transfer form with the corresponding amount, the title of the transfer and the Service Provider's data. After accepting the transfer, the Client is redirected back to the Website. Online payments made through the tPay payment system are handled by the company National Payment Integrator S.A. with its registered office in Poznań, Anders Square 3, 17th floor, 61-894 Poznań, entered in the Register of Entrepreneurs of the National Court Register by the District Court of Poznań - New Town and Wilda in Poznań, 9th Commercial Division of the National Court Register under the number KRS 0000412357. Customer data is transferred to the National Payment Integrator S.A., which is their personal administrator.
    1. Prepayment by traditional transfer (currently not available on sailor-klif.pl) to the Service  Provider's account: PL  66 1050 1230 1000 0090 8093 4616  SWIFT:  INGBPLPW stating in the title of the transfer the title that was sent in the confirmation email.
  2. For the reservation and the Rental Agreement, the Price at the time of booking is binding.
  3. In case of payment by the Client only prepayment, the remaining part of the Price for the Apartment should be paid in cash to the Hands of the Resident when transferring the keys to the Apartment.
  4. After the execution of each Lease Agreement, the Service Provider issues a receipt or VAT invoice to the Customer, provided that the User has indicated the data for its issue. The accounting document constitutes a written confirmation of the content of the reservation submitted and the conclusion of the Lease Agreement.
  5. The Service Provider undertakes to implement the Lease Agreement, including the provision of Apartments without defects, excluding any defects indicated in the offer on the Apartment Website.
  6. When handing over the keys to the Apartment, the Client is asked to provide the   Resident with proof of the Client's identity and a refundable deposit of PLN 300 or  EUR  100 is charged in cash to secure the payment of any damages incurred during the Client's stay in the Apartment. The deposit is returned to the Client on the day of departure from the Apartment after handing over the keys to the Resident and checking the condition of the Apartment, the Parties may in the relevant Rental Agreement set other conditions for the deposit.

CHAPTER 6: TERMS AND CONDITIONS OF THE APARTMENT RENTAL

  1. Check-in is only possible after you have read the apartment's terms and conditions and GDPR information and have signed them to indicate your agreement to their registration.
  2. Guests rent the apartment for the period and number of persons specified in the booking confirmation.
  3. Check-in is possible from 16:00 to 20:00 on the day of arrival, check-out takes place between 08:00 and 11:00 on the day of departure.
    • Guests are required to inform the guest of their arrival time at least 24 hours prior to arrival.
    • Guests are required to inform the guest of the apartment at the time of departure at least 24 hours before departure from the apartment.
    • In case of arrival or departure during hours other than indicated, it is possible to use the key safe located at the door to the apartment or a fee of PLN 50, payable in cash to the person operating the apartment.
  4. The apartment service charges a deposit in cash upon arrival at the apartment as security for damages and damages of 300 PLN / 100 EUR. In case of no damage to the apartment and the common areas of the building, the deposit will be refunded at check-out.
  5. Guests receive keys, which must be returned on the day of departure to the person handling the apartment. There is an additional charge for losing your keys and/or remote control.
  6. In the event of any failure, the landlord has the right and obligation to report it and to seek appropriate assistance provided by the person operating the apartment.
  7. Silence is between 22:00 and 06:00.
  8. Smoking inside the apartment is strictly prohibited. If a non-smoking ban is found to be violated inside the apartment, a penalty of PLN 500 will be charged.
  9. The owner and the staff are not responsible for the personal belongings of guests left in the apartment during or after their stay.
  10. Please note that the vat invoice for your stay must be submitted at the latest at the time of booking confirmation. It is not possible to invoice for your stay later.
  11. Guest responsibilities:
    • Guests are financially liable for all damages and equipment shortages incurred in the apartment and common areas of the building during their stay and agree that any repairs to the damage or defects caused by their faults will be made at their expense.
    • When handing over the keys, guests are required to report defects, damage caused during their stay and repair costs to the person handling the apartment.
    • Guests are required to hand over the apartment as they were.
    • Parties are not allowed in the apartment.
    • It is forbidden to use illegal substances in the apartment.
    • Please note that pets are only allowed in the apartment with the permission of the apartment owner and at an additional cash fee of PLN 50/night.
    • only toilet paper, other hygiene products, paper towels, etc. should be thrown into the toilet. please throw only in the trash can.
    • On the day of check-out, guests undertake to take all personal belongings from the apartment and log out of the streaming platforms on the TV. The owner of the apartment and its service are not responsible for not guarding these activities.

Guests agree to comply with the terms and conditions. Otherwise, the owner of the apartment or its service may refuse to rent the apartment, or shorten the rental period of the apartment with immediate effect.

CHAPTER 7: COMPLAINTS

  1. In the case of complaints regarding   the Reservation, Apartment or  Rental Agreement, the Client is asked to send them electronically by e-mail to the following address apartamenty@sailor-klif.pl or in writing to the following address: GMS Global Sp. z o.o., ul. Zagórska 83, 42-680 Tarnowskie Góra.
  2. In order to facilitate the handling of the complaint, the Customer is asked to provide the following data: name, exact period of stay, booking number, e-mail address and to accurately describe the defect and request of the advertiser.
  3. Complaints are considered within 14 days of the submission of the relevant complaint, in accordance with the applicable regulations. The Customer will be informed about how it will be considered by the Service Provider.
  4. The Service Provider informs that it agrees to settle consumer disputes under the Act of 23 September 2016 on out-of-court resolution of consumer disputes (Journal of Laws 2016, item 1823). In the event of non-recognition of the complaint by the Service Provider, the Consumer may use out-of-court means of dealing with complaints andredress.

CHAPTER 8: PERSONAL DATA AND OTHER PROVISIONS

  1. By making a Reservation, the User concludes the Rental Agreement using the Website and/or by subscribing to the newsletter and/or by contacting the Service Provider by e-mail, telephone or contact form, he/she provides the Service Provider with his/her personal data.
  2. In case of contact with the Service Provider, the legal basis for the processing of personal data is the legitimate interest of the Service Provider to perform the Lease Agreement and/or take steps to book and/or conclude a Rental Agreement (contact with the User) and build positive relations with the Users of the Website. If you subscribe to the newsletter, the legal basis for processing your personal data is your consent.
  3. The User's personal data is used by the Service Provider only for the purpose for which it was provided by the user: for the purpose of contacting the User, and/or making a Reservation and performing the Lease Agreement, and/or sending information of an advertising, commercial, marketing (newsletter) nature by e-mail.
  4. The controller of personal data is the Service Provider. Providing personal data is voluntary, but necessary for the purpose of contacting the User and/or making a Reservation and performing the Lease Agreement and/or sending the newsletter. Personal data provided to the Service Provider will not be transferred to third parties for any purpose other than those indicated in the Regulations, without obtaining the User's prior separate consent.
  5. The Service Provider also informs that the User has, at any time, the right of data portability, the right to access the content of personal data and the possibility to correct them, object to the processing of data, and consent to the processing of data may be revoked by the User at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.   6. The User also has the right to lodge a complaint regarding the processing of personal data with the President of the Office for Personal Data Protection.
  7. The Service Provider hereby informs that it never asks for an e-mail address in the content of the e-mail or other personal data of the User, and does not transmit, sell or lend the collected personal data of users to third parties, unless with the express consent or at the request of the User, or at the request of authorized under the law of the state authorities in connection with ongoing proceedings.
  8. The Service Provider processes personal data provided by the User of the Website in a manner consistent with the scope of the consent granted by the User and the requirements of the law, including the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), in particular safeguards the personal data of Users, Customers against unauthorized access, loss or damage.
  9. The Service Provider informs that in accordance with the provisions of Article 38.lit. l) of the Consumer Act, the Consumer has no right to withdraw from the contract in respect of contracts for the provision of accommodation services, other than for residential purposes, carriage of goods, rental of cars, catering, services related to rest, entertainment, sports or cultural events, if the lease agreement indicates the date or period of provision of the service.
  10. In matters not regulated by these Regulations, the relevant provisions of Polish law, in particular the Civil Code, the Act on the provision of electronic services and, in relation to Consumers, also the Consumer Act, shall apply.
  11. For the avoidance of doubt, it is stated that nothing in these Regulations limits the consumer's rights under the provisions of the law in force in the territory of the Republic of Poland. In the event that the provisions of these Terms and Conditions do not comply with the above provisions, those provisions shall prevail.
  12. The Service Provider is entitled to make changes to these Regulations for important reasons (e.g. change of applicable regulations, change of booking rules). In the event of changes to these Terms and Conditions, the relevant information about the changes to the Regulations will be posted on the Website at least 14 days in advance before the effective date of the changes. In the absence of acceptance of the amended Regulations, the User has the right to cancel the use of the Website and terminate the Agreement for the provision of services. This does not exclude or limit your right to opt out of using the Website at any time.
  13. The content of these Terms and Conditions may be recorded by printing, writing on a medium or downloading from the Website at any time.
  14. The provisions of the Regulations shall be interpreted in such a way as to ensure that they comply with applicable laws.
